The current template (as at 10th Sept 2009) features a header photo that I took some 4 years ago just outside the small country town of Guyra NSW,

I would rather OBAMA as leader of the United States of America than some ex-actor or tired old Hack Politician. Whatever Ethnic, Cultural or Religous background of the leaders parents, has little to do with his potential ability to lead. With his diverse background and resultant immense support amongst marginalized minorities, he WILL be remembered as one of the greatest Presidents the United States has ever had. Enjoy and embrace being alive during his term in office. Something to tell your grandchildren about in 20-30 years time.

Finger-pointing about his background is the sort of petty minded schoolyard crap that has infiltrated politics. Anyone that has trouble with OBAMA’s heritage should RE-Read the US Constitution and Declaration of Independence. Your country was founded on the principles of fairness and equitable treatment of ALL people

I note with some amusement that Yahoo has given up the search engine market , Microsoft’s BING.com search is now being used . That is exactly why yahoo has lost credibility in the SEO field . Anyway who would use the words ” I BINGed it” when “I googled it” is so endemic in conversation already. I note however that in Australia
Yahoo7.com.au is still using the old search engine (decisions.net.au is currently 2nd Place for search term “Decisions”)

Contacted support to see if maybe it was a dud download or an unfinished template that had been supplied in error. No Support not only said it was the correct one, but implied it was the best available on the planet. But they did have a premium service that would add the missing bits for expensive fee (more than triple the original price). I asked for my Money back, after all it was unusable. Support offered to check that there was no problems, if I gave them logon details. After checking and confirming the template was OK (their point of view, not mine). Was told that no refunds were given, but I could have a 50% on my next purchase. AS IF I would ever buy from them again.

So let’s do a little headcount.

Simply TERRIFIC. Brilliant. I can now CREATE Joomla, WordPress, Drupal and HTML templates with a few clicks.

I now have purchased 3 licensed copies, 1 for each computer. Bloody brilliant software.

Issues like passports, visas, work permits, housing are easily handled by most people via official Government sites,the only issue that isn’t is the international removals process. The hassles start with decisions about what belongings should be left behind, sold off, or given away. After deciding the amount of belongings being taken to your new home in a different country, then comes the hassles associated with international removals. 10. No Dead Politicians on our Currency. We have pictures of people that have made a real contribution to our country, not some loser politician.

It just reinforced my previous concerns about eCommerce sites, especially hosting companies and their usage of paypal. I get totally frustrated by supposed Hi-tech sites that don’t offer paypal or have only limited usage. Come on guys, Lift your game. Web-Users love paypal. We don’t want a online site that only expects Credit Cards. Or that un-named site I visited recently that only offers Direct Deposits for payments. That site sells (probably not many) pre-made eCommerce sites that feature Paypal payments, but they don’t accept Paypal.

Several deciding factors were responsible for this.
Firstly, after much deliberations, I have finally decided to shift all the remaining sites and clients from my old Hosting. The Costs and Hassles associated with the old Canadian Host was not worth it. For the same price per month I have over 5 times the space and 10 times the bandwidth.

Secondly, With the winter months and the prevalance of sniffles and coughs, I have not been doing as much website work as usual.

Thirdly, I have been trying to change the entire focus of BareFootTech. In the last five years it has changed from having only 1 Blogger blog (SpamCity, It was YUK ) and a site (Mega yuk) hosted on the 5mb Hosting provided by my old ISP neither listed by google and other search engines. It now has achieved a little success with several high traffic sites and several blogs. Over the next 5 years I hope to make some money as well as the recognition I so deserve.

Reading a recent news feed , there was an item about a Loser (literally) that has sued a Gambling Casino for allowing him to lose. I wonder, what part of the concept of gambling has escaped him. Life is a gamble at the best of times, but thinking that a casino would have an implicit duty of care to prevent a client losing is ludicrous.

Having a love of all things, my family and I have been feeding several young birds some tidbits. However recently some free-loaders have started to expect to be totally fed by us. Yesterday we had over several birds swoop in when food was placed outside for a little bird.

Applications for US immigration need to have and pass a proper immigration background check. And once an individual passes this background check, it will establish the person’s residence eligibility. Background checks that will be used for immigration are performed by the agency in-charge of the process. For those applying for US migration, the back ground check is with the agency of the U.S. Citizenship and Immigration Services or the USCIS which is the federal agency handling the checks on applicants for immigration visa processing. But currently, due to the 9/11 attack, the US has started increasing their immigration background checks to ensure the safety and level down the possibility of the country experiencing another terror attack. Immigration background checks are now conducted for security purposes and so a large number of applicants are routinely inspected and many passed the test without any incidences. Yet many advocates of the USCIS procedure are concerned with the new time-consuming procedure as it takes a long time because of the three-tiered approach being used on background checking. This process would mean a year or more of waiting for an applicant before he or she gets visa approval.

Immigration background check involves three different process in investigation techniques such as the Interagency Border Inspections System or the IBIS Name Check, FBI fingerprint check and the FBI name check. Applicants should pass these three test before the interview schedule is given. If any of the checks gets a negative result after investigations are made, the immigration process will be a failure.

The first process of the immigration background check is done by the IBIS which is a multi-agency, centralized system acquiring information for different sources to instantly know whether an applicant is qualified or if more background checking is needed. Fingerprint checks from the FBI usually take about twenty four to forty eight hours, and if criminal records comes up, an adjudicator of the USCIS will determine if the possibility of continuing or not continuing the investigation.

If records or violation shows ineligibility for award of green card for the applicants, the investigation will be discontinued as recommended. The final procedure that applicants must go through is the name check of the FBI. This takes only about 14 days or longer if there is a need for further resolution or some results needs further investigation. When applicants passes all these checks, they will have a greater chance of getting into the US to live or work.

It seems easy, but if you really think about it there is a value that is assigned to your product. You are trading a commodity for cash. In turn you use that cash to either buy new products or as profit to meet your own personal bills.

In many ways the consumer is smarter today than ever before. They are in the driver’s seat in online transactions. Respect them enough to deal honestly with them. You might just be rewarded for the gesture.

For one thing, your name change petition is going to have to be ratified by a judge, and there is little desire on the part of the court to formalize frivolous name changes. For example, actors often go by one name when their actual given name is something else entirely. There is a good reason behind this, often absolutely unconnected with any desire to get away from an embarrassing name (although if an actor feels that their original name is one that might not fly as well as an alternative, they can go with that). It is safe to say that Michael Herbert Dengler was aware of this when he undertook legal action in 1976 to undertake a new identity. It is equally safe to say that he had his reasons for wanting to change his name to “1069″. Indeed, they are listed in the petition, but to list them here would take too much space. Suffice it to say that his reasons were personal philosophical ones that he felt necessitated the change. The Supreme Court for the State of North Dakota was, however, unwilling to allow this, opining that the use of a number as a name could be excessively confusing. As a compromise solution, the Minnesota Supreme Court offered the possibility of “Ten Sixty-Nine” three years later when Dengler tried again, a compromise he accepted.

In 2008, a nine-year-old girl had different reasons for asking a court in Wellington, New Zealand, for a name change. Having been christened “Talula Does The Hula From Hawaii”, the girl felt somewhat self-conscious about her name, which caused her to be teased at school. As a consequence of her action, the unfortunate Talula was made a ward of court so her name could legally be changed. What to? Well, that information seems thin on the ground, perhaps specifically because of the publicity the case attracted – so when the girl is asked her name and tells the asker her new name she is not instantly greeted with “Oh, hi Talula Does The Hula From Hawaii”. Perplexingly enough, the same court has ruled that names such as Midnight Chardonnay, Number 16 Bus Shelter and even Violence are permissible. At least they blocked “Yeah Detroit”, “Fat Boy” and “Sex Fruit”.

Court decisions often differ between US states. For instance, Ohio resident Robert Handley asked in 2000 to be allowed to change his name to Santa Robert Clause, because of the existing legend of Father Christmas. A year later, however, the Utah Supreme Court was less restrictive when David Lynn Porter petitioned them for the right to be known as just plain Santa Claus, arguing that he had the right to select the name under which he went “within very broad limits”.

Those limits were presumably the ones that prevented Russell Lawrence Lee from changing his name to “Misteri N*****” (author’s censoring), where the second “I” of the first part is silent, and the second part is a well-known racial epithet. Though Lee himself was African-American and his use of the word in question was therefore judged not to be of insulting intent, the court ruled that Lee could call himself whatever he liked in conversation, but would not be given the court’s permission to legally go by that name.

The basic and simple maxim and guideline to live by of disassembly and reassemblies of auto and automotive components – is never to force anything, ever. If you find that you are not sure or unsure – then stop dead in your tracks. The second rule and corollary is always to carefully note and mark down everything – their configurations and placements, plus any other relevant and useful information and data. Do this both mentally as well as in writing your notebook or tablet laptop computer. How were these automotive components assembled originally? How were they put or held together? In what and which the sequence were or did they came apart. On top of that take the time to note as well, and to locate if they fall off the workbench or spring of what fasteners and fittings were used. Pull out a blank sheet of paper and place a line down the middle of the sheet, from top to bottom. On the left hand side of the sheet, enter all of the above key barriers. At the top of the sheet, label this list with “Forces Against Change”. On the right hand side of the sheet, list the above key success factors and label the list “Forces For Change”.

Now place a line under each factor pointing to your center line. Make the length of each line proportional to the strength of each force; either for or against the planned change. You have now an instant picture of the current health of your change program. At trial the insurance defense attorney hired by the at-fault driver wants to tell the jury about the discounts and Medicaide payments.

Will the trial judge allow him to do so?

No, says the “collateral source rule.” At least not if she lives in one of the states that still support the rule.

Collateral Source Rule Explained

The term “collateral” as used here means simply “additional”. The at-fault driver or “tort-feasor” as the law calls him, is responsible for making the injured person whole.

This includes making sure her medical bills are paid. Medicaide and the discounts are “additional sources” that have helped make Sally whole by paying her medical bills.

In the American legal system laws can be made by legislatures, administrative agencies, and by courts. The law created by courts is known as common law. The collateral source rule was court created in 1854.

The essence of this rule is summarized in Black’s Law Dictionary as follows:

“…if an injured person receives compensation for his injuries from a source wholly independent of the tort-feasor, the payment should not be deducted from the damages [monetary compensation] which he would otherwise collect from the tort-feasor. In other words, a defendant tortfeasor may not benefit from the fact that the plaintiff has received money from other sources as a result of the defendant’s tort.”

It is an evidentiary rule which means that the injured person has the right to ask the judge to keep evidence of collateral source payments away from the jury.

The most common collateral sources are medical insurance, workers compensation, VA medical benefits, Medicaide and other government programs.

Medical Discounts

While some states have refused to give medical discounts the protection of the collateral source rule, the majority opinion is just the opposite. A majority of states permit a plaintiff to recover the amounts billed for medical care, even when those amounts are discounted by the health care provider pursuant to a contract with the injured person’s health insurer.

States That Have Modified Or Eliminated The Rule

The legislatures of twenty eight (28) states have either abolished or modified the collateral source rule.

These states are as follows: Alabama, Alaska, Arizona, California, Colorado, Connecticut, Florida, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Michigan, Minnesota, Missouri, Montana, New Jersey, New Mexico, New York, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, West Virginia.

Here is a list, as of the date of this article, of the fourteen states that have completely abolished the rule: Alaska, Colorado, Connecticut, Idaho, Indiana, Iowa, Kansas, Michigan, Minnesota, New York, North Dakota, Ohio, and Oregon.

Even if you live in a state where the rule has been abolished or limited by the legislature, you should check on the current status as some state supreme courts have overruled the legislature and reinstated the rule.

Conclusion

If yours is one of the twenty two states that still have the collateral source rule in full or one of fourteen that have retained it in part, you need to know about and understand it.

Insurance companies will try to reduce your compensation by amounts which your health insurance has paid. Be alert, don’t let them put the evidence in front of the jury.

It’s a typical January morning as Sally leaves her home in Murray and enters I-15 headed for work at a law firm in downtown Salt Lake City. It is 7:30 a.m.

At the same time a large semi loaded with steel windows is approaching from the South. The driver, a long-haul veteran of 20 years over-the-road service for a major national trucking company has been up since 3:30 a.m.

Suddenly the driver slumps forward, lack of sleep from week-long road trip have caught up with him. His truck drifts slowly to the right, into the adjacent lane.

“BANG!” The trucker’s right-side mirror has just clipped the mirror of a flat bed truck in the adjacent lane.

The noise and accompanying jolt are enough to wake the trucker but his hasty response now imperils other drivers. He overcorrects into the left-lane where Sally is motoring peacefully to work.

The sudden impact abruptly changes Sally’s direction and she veers sharply across the media into southbound I-15 traffic. The head-on collision ends Sally’s life and that of the southbound driver.

The Logbook

In the truck accident legal case that followed, the lawyer for Sally’s family requested the driver’s logbook.

The logbook showed that the driver had been on the road for only two hours. Suspicious, the family’s lawyer, requested bills of lading, fuel receipts, and electronic data from the Global Positioning System used by the driver’s company to track his whereabouts.

The GPS data showed what the lawyer had suspected–the logbooks were falsified.

Federal law requires interstate drivers to record, either in written or digital “logbook” how they spend their workday. An interstate trucker is limited to 11 hours over a fourteen hour period. And once that eleven hours are up he must take a rest break lasting for at least ten straight hours.

I know in my local town whenever a shop closes, it often re-opens as a coffee franchise. Starbucks, Costa Coffee, Tchibo, Nero…there are many to choose from.

And no matter how many there are in each town, you always have to queue. So many people are now finding the time and money to have a coffee with friends. Relax a bit, have a good gossip and simply enjoy each other’s company.

My wife and I go to relax, so the following is important to us:

Traffic tickets are writs issued by the traffic police officers to road users whenever they cross traffic rules. The road users who receive these traffic tickets range from motorists, car drivers to bus drivers. These traffic ticket cases are heard in the traffic courts and the tickets are issued there.

Types of traffic tickets

Traffic tickets are generally issued for two major types of traffic crimes namely,

1. Moving violation
2. Non-moving violation

There are two places you can purchase these used cars on the lot of a new dealership and used cars by owner. When you find them on the dealers lot most of the time they are trade-ins of someone wanting to upgrade. A trained mechanic should have inspected these cars at the lot; they may even come with a small limited warranty.

Used cars for sale by owner, however, have been checked out by no one but you. This is not necessarily a bad thing. All you need is a little knowledge before hand and you should have no problem buying the used car for sale by owner.

Mechanic

The question is should you have a used car checked by a mechanic before you buy it? What may be a witness?

The common law often excluded weird witnesses as incompetent. Now, virtually everyone is presumed “competent” to be a witness under Fed. & S.C. Rs. Evid. 601. There are a few exceptions.

The presiding judge cannot be a witness in the same case over which he or she presides. Rule 605. A juror is incompetent to testify, although in rare cases the juror might be allowed to testify about extraneous prejudicial information or outside influences on the jury itself. Rule 606. Then there are statutes such as the Dead Man’s Statute and the parol evidence rule (actually both a statutory rule under the UCC and also a common-law rule) which make witnesses incompetent.

Like I said, there aren’t many exceptions to competency. The more difficult question is whether certain weird witnesses, although technically competent, may or should be called.

Post-trial testimony by judges

Okay, judges aren’t weird. However, they aren’t your everyday witness. Rarely are judges absolutely barred from testifying in trials where they are not the presiding judicial officer. When a judge’s expected testimony is about something that arose in a prior trial or case, no one wants to call him or her unless absolutely necessary. I suspect that the issue arises more often with the state judiciary than in federal courts, and in my experience, the judge typically sought to be a witness is a state magistrate. This is true for two reasons: (a) first, although record-keeping is much improved in modern times, sometimes the magistrate’s record is incomplete; (b) second, magistrates sign arrest and search warrants which are occasionally the subject of attack in general sessions courts in motions to suppress.

So what’s the rule? Judges aren’t prohibited by Canon 2 of either the Code of Conduct for United States Judges or the South Carolina Code of Judicial Conduct from acting as involuntary (i.e., under subpoena) character witnesses; however, Canon 2 requires the judge to discourage someone from calling her, except when the demands of justice require it. Think about it – imagine how uncomfortable you as an adverse attorney would be if you had to impeach a judge’s credibility?

Judges also are competent to testify in later trials about a prior case over which they were involved as the judicial officer. However, the modern trend is not to let them, “unless the testimony: (1) is critical, and (2) can be obtained by no other means.” In re Whetstone, 354 S.C. 213, 580 S.E.2d 447 (2003). See also United States v. Dowdy, 440 F. Supp. 894 (W.D. Va. 1977) (examination of judges as to basis for their opinions disallowed “absent extreme and extraordinary circumstances”). “To show extraordinary circumstances, a presumption as to the regularity of the acts of public officials must first be overcome.” Id. 440 F. Supp. at 896.

Canon 2 also warns against judges sua sponte communicating information to a sentencing judge or a probation or corrections officer. However, a judge may provide information to them if formally requested.

Executive officers

Yes, even executive officers can be made to testify. President Monroe answered written interrogatories, President Nixon had to respond to subpoenas, and President Ford was deposed in a criminal prosecution. Mark Sanford has been sued in a declaratory judgment action in which it was claimed that he was ineligible to serve as governor.

The apogee of a federal executive officer’s involvement with the judicial process is Bill Clinton. He testified in two video depositions for use in criminal proceedings. That was just his start. Paula Jones v. William Jefferson Clinton, 520 U.S. 681 (1997) shows that even the highest executive officer in the land may be sued for wrongdoing while in office. Similarly, in Paula Jones v. William Jefferson Clinton, 36 F. Supp. 2d 1118 (E.D. Ark. 1999), President Clinton was tried and found in contempt. Judge Wright found that his conduct (lying in depositions, interrogatories, an affidavit, and through his attorney – stuff like that) involved dishonesty, fraud, deceit or misrepresentation, or was prejudicial to the administration of justice. Oh yeah, then there was the impeachment before the House of Representatives.

Other officials in the executive branch may be deposed assuming they have knowledge of important facts. Atlanta Journal and Constitution v. Atlanta Dept. of Aviation, 175 F.R.D. 347 (N.D. Ga. 1997) (mayor of Atlanta). Nonetheless, the higher up the food chain, the less inclined a judge will be to allow discovery. For example, it’s been held that an oral deposition of a cabinet-level official usually won’t be allowed. Peoples v. Dept. of Agriculture, 427 F.2d 561 (C.A.D.C. 1970). Moreover, as with judges, a member of the executive branch should not be deposed or examined about his official decision-making process when the decision was made in a quasi-judicial manner. United States v. Morgan, 313 U.S. 409 (1940) (Secretary of Agriculture).

Legislators

Though they are excused from court on certain days during the legislative session, legislators generally are competent and not privileged from testifying at trial. Occasionally one hears of a congressman or senator being called as a character witness, such as when Senator Daniel Inouye recently testified in Alaska Senator Ted Stevens’ criminal trial. Once I had an opponent name a legislator as a character witness just days before trial. After thinking about it, I agreed to waive the late notice if my adversary promised to call the legislator.

More interesting is whether a legislator may testify at trial about the legislative intent behind a statute he wrote or with which he was involved. The federal courts do take notice of legislators’ comments on the house floor during the legislative process.

It’s much harder to determine what goes on in the South Carolina General Assembly, which has steadfastly rejected real accountability. The legislators usually do voice votes so usually no one knows for certain how they vote. Thus, it’s with some logic that since the days of Justice John Rutledge, South Carolina courts refuse to allow members of the General Assembly to testify about the legislative intent of a law, even when the statute’s wording is unclear. See Executors of Rippon v. Executors of Townsend, 1 S.C.L. (1 Bay) 445 (1795).

Bailiffs, sheriffs, and clerks of court

Cases go both ways on the propriety of calling either a bailiff or a deputy assigned as courtroom security to testify during trial. Obviously, because the bailiff is a law-enforcement officer of sorts employed by the sheriff, there is a danger of prejudicing the defendant. Some courts find a bailiff working at a trial per-se incompetent to testify. Other courts allow a bailiff, or sheriff acting as bailiff, to testify depending upon the situation. The issue often turns upon how closely the bailiff is associated with jurors at trial. For example, a bailiff who merely called out the names of jurors while assisting the clerk during voir dire is less likely to influence them than the specific bailiff assigned to escort and guard the jury throughout trial. See generally 98 C.J.S. Witnesses § 197 (Supp. 2008).

More common (and less problematic) are scenarios where a clerk of court is called to testify about the authenticity of court records in her office. This practice is typically allowed. It’s rare to find a case where a party was denied the right to call a clerk as a witness (or objects to a clerk being called).

The ultimate in weirdness

In closing, here’s the oddest of all South Carolina litigation weirdness. In 1935, Gov. Olin Johnson became awfully tired of top Highway Commissioner Ben Sawyer and his gang of pesky confederates interfering with Johnson’s politics. They weren’t carrying out his policies. (Sound familiar?) What took place sounds like a banana republic.

One clear October day shortly before Halloween, the Governor issued a proclamation. In it, he declared the state highway department in a state of “insurrection” and “rebellion.” Gov. Johnson called out the state militia (newly named the “Insurrectionary Troops”) under Major Frank Barnwell. Barnwell was ordered to seize all highways, ferries, and bridges.

Major Barnwell simultaneously invaded the State Office Building where the highway commission’s offices were located. Machine guns were planted at building’s entrances. Sentinels were posted around the building. When the members of the highway commission tried to enter, they were repelled. New, loyalist highway commissioners were appointed who fired the 2,000 employees of the commission, including Ben Sawyer. The militia also seized control of several banks having highway department money. Habeus corpus was suspended.

The supreme court heard the matter in its original jurisdiction. In a 13-page unanimous opinion (per curium, naturally), the court told the Governor that there was no insurrection, to get over it, and reestablished the status quo. Thanks goodness for the judiciary. For the ultimate in weird, every lawyer should read Hearon v. Calus, 178 S.C. 381 (1935).

[Email to Bob Brennan] “I incurred the debt some years ago and my original thought was that it was past the statute of limitations regarding collection of credit card debt (which I understand to be 4 years in California) but when I looked at my credit report it then seemed that they might have beat the 4 year period by about a month. I did a bit of looking and could not find anything concrete that showed that the debt had been delinquent for more than 4 years, so I decided to call the law office listed on my summons today to see if we could work something out that was a bit more reasonable than the amount they stated on the summons (which is 4600 dollars or so which to me seemed kind of ridiculous to me seeing as my original limit on the card was 2200). The guy I got on the phone said that the amount we were looking at now was actually 6600 because the law office was involved and the best settlement he could come up with was roughly 3600 if I agreed and could pay 1/3 of that today, and then the rest over the next 2 months, which I can’t swing at the moment. The other option from him was to start smaller payments today on the total 6600 to avoid going to court. He also told me that today might be the last day this is on the table since it was the last day of the month today, I am not sure how much of that was to try to scare me into making a bad decision or what. That did not seem all that reasonable to me, so I thought I might want to get in touch with a lawyer who specializes in this type of thing since I don’t think I am going to be able to make any progress on my own, or even figure out what I need to send back to the courts within the thirty day window I have. By “organic”, I am not referring to changing your eating habits when you have a personal injury claim pending. Rather, it is an observation that juries and judges no longer accept cases where they feel there has been excessive intervention, or “tampering” by the attorneys involved.

Example: 25 years ago, someone with a personal injury claim came to an attorney. The attorney had his “stable” of doctors, chiropractors, physical therapists, etc., all ready to “treat” the patient. Of course, since the medical professionals were in essence working for the attorney, they would overtreat the patient and run up unnecessary medical bills. No matter, because the insurance companies knew of this practice and would make low settlement offers. Negotiations would ensue and the matter would usually settle, with the attorney and the medical professionals involved all adjusting their bills to make the settlement work. While no one will claim that this process was entirely honest or decent, a lot of personal injury cases resolved this way and the system essentially worked for over two decades to resolve most personal injury claims out of court.

However, beginning in the 1990′s, the scourge of “tort reformers” (big business interests) decided to re-write laws so as to deprive consumers of their day in court while preserving their own day in court. “Tort reform” is now largely an international phenomenon, because big multinational business interests want to make profit in America but do not want to be subject to America’s laws which protect consumers. Thus, big business hatched PR campaigns designed to turn consumers against attonreys and against the very justice system which protects them. The campaign began with a few insurance companies but quickly spread throughout international mega-business interests and even found a home with a whole generation of conservative politicians.

The campaign has lost some steam because, alas, American consumers suddenly have connected the strength and vitality of the court system with such things as not having dangerous lead-based paint on imported toys and in having remedies against corporate crooks who steal and bankrupt pension funds.

One lasting consequence of the campaign is that jurors now distrust personal injury plaintiffs. Plaintiffs who come to court with real injuries, having been treated by real doctors and medical professionals, still do well in court. However, plaintiffs that come into court with doctors arranged through their attorney’s office are subject to far greater scrutiny, and often lose or collect minimal damages.

The solution? In our office, we’re “going organic”. We present the case with a minimum of tampering. We encourage our clients to treat with their own doctors and go through their own medical provider systems for treatment. We present what their own doctors tell us. We don’t try to overtreat and we don’t try to inflate any injuries suffered by our clients. Nor do we understate them. We simply present what’s there to be presented. Brain injury can occur from a minor impact to the skull. It can also happen without impact to the skull.

This latter is known as a contrecoup concussion. Rapid movement of the head forward and backward can cause the brain to move forcibly against the front of the skull causing injury to the delicate organ.

SYMPTOMS

Some of the common symptoms of a brain injury are as follows:

1. Vomiting–if you observe someone throwing up after an accident get them to a doctor right away.

2. Unconsciousness–a reduced state of consciousness is often caused by a head injury. Doctors have developed the Glasgow coma scale to gauge the severity of loss of consciousness:

Once you have determined that a symptom is present after an accident but also before the accident ask yourself “is it the same? or is it worse?” Worsening of a pre-existing symptom may be evidence of a head injury.

You then total up the number of symptoms that were not present before the accident or, if present, were worse following. The greater the number of symptoms, the greater the likelihood of a head injury.

Discuss the results with your primary doctor and, if he deems it appropriate, get a referral to a neuropsychologist who can interview you and, as necessary perform a battery of tests to objectify the injury and its effects on your cognitive functioning.

According to a story in the New York Times, 102 previously sealed documents were made public earlier this year in a lawsuit brought by drug users against the manufacturer.

The story, by the Times writer Duff Wilson, quotes AstraZeneca publications manager John Tumas making the following statement, “…how do we face the outside world when they begin to criticize us for suppressing data.”

Seroquel (generically known as Quetiapine) is an antipsychotic drug used to treat acute manic episodes associated with bipolar I disorder. It is also used to treat schizophrenia. Seroquel has been linked to an increased risk of diabetes and blood sugar disorders including hyperglycemia.

Hyperglycemia can lead to cardiovascular disease, kidney failure, coma, and even death. Diabetes mellitus can cause erectile dysfunction, blindness, and gangrene. Recent studies have shown that people taking Seroquel are 3.4 times more likely to develop diabetes than patients taking other medications.

Other side effects of Seroquel include neuroleptic malignant syndrome (which is characterized by fever and muscle rigidity) and uncontrollable movements.

Seroquel, an antipsychotic medication manufactured by AstraZeneca, is an oral drug that manages symptoms of bipolar I disorder and schizophrenia including delusions, hallucinations, social withdrawal, lack of energy, apathy, thought disorder, and inability to express emotion.

Zyprexa, also an atypical anti-psychotic, was the subject of numerous lawsuits in recent years by users claiming the maker failed to disclose that the drug caused diabetes.

Eli Lilly, the manufacturer of Zyprexa, has paid out hundreds of millions dollars to compensate those claimants.

Currently, similar suits against AstraZeneca have failed to achieve similar success. Though no Seroquel cases have yet made it to trial, the manufacturer has been successful on several occasions in obtaining dismissals of cases headed for trial.

However, with the disclosures from the sealed documents, it is possible that future trials my fare better for the Seroquel users. AstraZenaca faces lawsuits from more than 15,000 plaintiffs who allege they suffered diabetes from Seroquel. Many of these cases were filed in Delaware, where the drug was developed and where AstraZenaca has its headquarters.

Those lawyers representing the Seroquel users claim that AstraZeneca knew about the potential for diabetes and failed to disclose it and, therefore, compensation should be awarded to those who got diabetes from the drug.

If you are using Seroquel please do so advisedly by reading the warning labels and discussing their symptoms and side-effects with your treating physician.

A healthy way to live – in good times as well as challenging ones – is in the moment. Everything is impermanent; nothing remains the same. Although this basic truth can feel somewhat daunting, it can also be very liberating: when you recognize and acknowledge that everything is constantly changing you can stop wishing for what was and pay attention to what is and what could be.

It’s not uncommon for people who have lost a job to later say it opened up other possibilities they might never have explored, otherwise. It woke them up and made them focus on how they really wanted to spend their life.

You Will Be All Right

You’ll have ups and downs throughout your unemployment and at times you may feel like you’re on an emotional roller coaster. You may be in for a rough ride, but with the right attitude, you will get through the experience and arrive in a better place. For one thing, your name change petition is going to have to be ratified by a judge, and there is little desire on the part of the court to formalize frivolous name changes. It is in the judge’s discretion to uphold or reject a name change petition should he or she feel that there are reasonable grounds for doing so. This means that – as amusing as it may seem at the time – changing your name to “Superman” or “Luke Skywalker” may not come off as you had hoped it would. As it costs a lot of money to change your name, you need to decide whether the process is worth bothering with.
